Lekker Financials ("Lekker", "we", "us", "our") provides a cloud-based software platform designed to assist bookkeepers, accountants and business owners with the preparation, presentation and management of annual financial statements.

Lekker provides software and automation tools only. Lekker does not itself provide accounting, auditing, tax, legal or other professional advice, and nothing on the platform should be interpreted as such. You should consult a qualified professional where you need specific advice.

By using Lekker, you acknowledge that you remain responsible for:

• •The information you upload to the platform;
• •The accuracy and completeness of that information;
• •Reviewing automated mappings and classifications before relying on them;
• •Reviewing financial statements before approving, signing or distributing them;
• •Ensuring that financial statements comply with the applicable accounting framework (including IFRS for SMEs where relevant);
• •Obtaining appropriate professional review where required; and
• •Maintaining appropriate copies and backups of your original records.

Lekker may use automated processes, including artificial intelligence and machine-learning technology, to assist with:

• •Trial balance classification;
• •Account mapping;
• •Financial statement presentation; and
• •Other automated suggestions.

Automated classifications and suggestions are assistance tools only and may contain errors. You must review and approve all mappings, classifications, adjustments, disclosures and financial statement presentation before relying on, signing or distributing the resulting financial statements.

Lekker does not replace professional judgement. Validation, reconciliation, mapping and health-check functionality is intended to assist you and does not constitute an audit, independent review, compilation engagement or other assurance engagement unless expressly stated otherwise.

Any output generated by the platform should be reviewed by a suitably qualified person before being relied upon, signed or distributed.

You may upload confidential information to Lekker, including:

• •Financial information;
• •Accounting records;
• •Trial balances;
• •Bank statements;
• •Company information;
• •Director information;
• •Shareholder information;
• •ID numbers; and
• •Other personal information relating to your clients or third parties.

You are responsible for ensuring that you have the necessary authority and lawful basis to upload and process this information through Lekker. You should only upload information reasonably necessary for the services provided.

Lekker processes personal information in accordance with its Privacy Policy and applicable South African data protection legislation, including the Protection of Personal Information Act, 2013 (POPIA), where applicable.

We take reasonable steps to protect personal information using appropriate technical and organisational measures. However, no method of transmission or electronic storage is completely secure, and we cannot guarantee absolute security.

To the extent permitted by applicable law, Lekker shall not be liable for:

• •Automated errors;
• •Incorrect account classifications;
• •Incorrect mappings;
• •User-entered information;
• •Financial statement errors resulting from incorrect or incomplete information;
• •Loss or corruption of customer data;
• •Service interruptions; or
• •User reliance on automatically generated information.

Nothing in these Terms purports to exclude liability that cannot legally be excluded under applicable South African law.

You are responsible for keeping your login credentials secure and for all activity that occurs under your account. You must notify Lekker promptly if you believe your account has been compromised or used without authorisation.

Lekker's software, branding, interface, content and intellectual property remain the property of Lekker Financials. You may not copy, modify, distribute, reverse-engineer or create derivative works of the platform without our prior written consent.

You retain ownership of all data you upload to the platform. Lekker retains ownership of all generated mappings, templates, wording and platform functionality.

• •Purchases: Financial Year credits are purchased through the platform via available payment methods.
• •Financial Year credits: Each credit unlocks one Financial Year for editing, generation and export.
• •Use of credits: Credits are applied per Financial Year per entity.
• •Volume pricing: Volume-based discounts may apply for bulk credit purchases, as displayed at the time of purchase.
• •Referral credits: Referral credits are granted in accordance with the referral programme terms and may be subject to eligibility requirements.
• •Expiry: Specific expiry periods, if any, will be communicated at the time of purchase.
• •Refunds: Refund terms, if any, will be communicated at the time of purchase.
• •Cancellation: You may stop using the platform at any time. Purchases are governed by the terms presented at the time of purchase.
• •Payment processing: Payments are processed by third-party payment providers. Lekker is not responsible for payment provider errors or delays.

Lekker reserves the right to suspend or terminate accounts in the event of serious breaches of these Terms, misuse, fraud, or other legitimate reasons, to the extent permitted by applicable law.

You may stop using the platform at any time. Upon termination, your right to access the platform and any unlocked Financial Years will cease in accordance with these Terms.

These Terms are governed by South African law. Any disputes arising in connection with these Terms shall be dealt with in accordance with applicable South African legal procedures.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
